IFMK Senior Associates Joe Bracey and Kyle Moore won a full defense verdict with no liability after a four-day trial in federal court in the East St. Louis Division of the U.S. District Court for the Southern District of Illinois. Three plaintiffs filed suit against a county sheriff, chief deputy and deputy. Two of the plaintiffs alleged the officers violated their 4th Amendment constitutional rights during the execution of a search warrant, claiming the officers failed to knock and announce before entering the home and used excessive force. A third plaintiff also alleged the officers unreasonably delayed the return of property items seized as a result of the search warrant. The jury rejected the claims and returned a full defense verdict after an hour of deliberations.
