IFMK Law Attorney, Allison Schaeffer, recently won a 19(b) Arbitration on all issues for a client. The case involved an alleged slip and fall in a deli cooler with a requested shoulder surgery and a lengthy period of Temporary Total Disability (TTD) benefits. Following thorough witness preparation and a strategic cross examination of the petitioner the Arbitrator found the petitioner was not credible and Respondent’s witnesses were credible. The Arbitrator found further that the petitioner presented no credible evidence that an accident occurred that arose out of and in the course of his employment with Respondent, and thus he failed to prove that he sustained a compensable work accident. Petitioner’s claim for benefits was fully denied.
