IFMK Law Shareholder Bhairav Radia and Senior Associate Joe Bracey obtained summary judgment in favor of a county state’s attorney and sheriff’s correctional officers. Plaintiff alleged the state’s attorney’s office lacked probable cause to charge him with attempted murder. He delayed dropping charges after the victim recanted his identification of plaintiff as the shooter. Plaintiff further alleged that officials at the county jail denied access to attorney calls which led to his detention for seven days beyond when the charges were dropped, and that conditions of confinement were constitutionally deficient due to a sewage leak during his last night at the jail. The U.S. District Court for the Central District of Illinois found no question of material fact existed and entered summary judgment in favor of all defendants on all claims.
