IFMK Law Shareholder Bhairav Radia and Senior Associate Kyle Moore obtained summary judgment in favor of sheriff’s correctional officers. The plaintiff alleged several claims, including excessive force, false arrest, and malicious prosecution, against county correctional officers after he refused to exit the county jail following his release due to his mistaken belief that the correctional officers had taken his money. The plaintiff’s confrontation with the correctional officers resulted in him being detained at the jail. The Court found in favor of the correctional officers as to all claims and, in part, held that the correctional officers had probable cause to arrest the plaintiff and that nothing in the record permitted a reasonable inference that the force used was more than de minimus or objectively unreasonable under the circumstances.
