IFMK Law Shareholder Bhairav Radia and Senior Associate Joe Bracey obtained a favorable judgment for their clients, a municipality and public entity risk pool. Plaintiff, who refused to repair or demolish an unsafe garage, filed two prior suits against municipal employees and officers. After those suits were dismissed for failure to state a claim, plaintiff then filed third suit alleging municipality, insurer and defense attorneys were engaged in civil RICO conspiracy. The district court found plaintiff failed to state a claim and the Seventh Circuit affirmed on appeal, finding plaintiff failed to allege any necessary injury to his business or property.
