IFMK Law Shareholder Bhairav Radia and Senior Associate Joe Bracey obtained a favorable judgment for their client, a county correctional officer. Plaintiff alleged the officer failed to protect him from assault by another inmate when the officer should have known the other detainee had a propensity for violence. IFMK attorneys moved for judgment on the pleadings arguing plaintiff’s claims were time-barred as plaintiff filed suit two days after the two-year statute of limitations period. In granting the motion, the Court rejected plaintiff’s argument that the limitations period should have been tolled while he attempted to complete the jail grievance procedure because undisputed evidence showed that plaintiff could have filed his grievance within the required timeframe but did not do so.
