IFMK Law Partner, Karin Anderson, secured summary judgment for a Village in a lawsuit filed by the Public Works Director in the Circuit Court of the Fifteenth Judicial Circuit, Carroll County, Illinois. Plaintiff alleged retaliatory discharge for filing worker’s compensation claims. The Village President, Plaintiff’s supervisor, counseled Plaintiff several times about his tardiness, absenteeism and miscalculation of compensatory time prior to filing his first claim at the Worker’s Compensation Commission. Thereafter, Plaintiff received a written warning for his poor performance and then filed his second worker’s compensation claim. Karin argued that the Village President terminated Plaintiff for valid, non-pretextual reasons that were unrelated to his worker’s compensation claims, and the Court agreed.
