IFMK Law Attorneys Prevail on Motion to Dismiss Federal Claim Based on Qualified Immunity
IFMK Law Partner, Julie Bruch, and Associate, Julien LeBlanc, prevailed on a Motion to Dismiss in the United States District Court for the Southern District of Illinois. Plaintiff filed suit against the Village and the Village’s police chief after he was terminated from his position as a police officer for insubordination. Plaintiff alleged that he was a non-probationary police officer under the Village’s policies and that the police chief violated his procedural due process rights when he was terminated. The District Court agreed that the police chief was entitled to qualified immunity and dismissed the federal claim with prejudice.
