IFMK Law Partner, Jane May, was a featured presenter at PRIMA’s 2024 annual conference in Nashville, Tennessee. Her presentation, Can the Public Be Silenced? Emerging Law on First Amendment, focused on the recent Supreme Court opinion in Lindke v. Freed, which set forth the “state action” standard for public official liability under the First Amendment for censoring detractors on social media.
The PRIMA audience was comprised of public officials, attorneys who represent public bodies, and insurance professionals. May explained the current state of the law and provided practical tips for avoiding First Amendment liability when using social media. Following her presentation, May noted that this is quickly evolving area of the law.
