IFMK Law (IFMK) attorney, Lance Neyland, filed briefs in the case of a bicyclist who rode over a sewer grate on the shoulder of a roadway in the City of Moline. He fell and cut his face and fractured his wrist. After hearing oral argument, the court granted summary judgment in favor of IFMK’s client, the City of Moline, on the basis that the City was immune from liability under Section 3-102 of the Illinois Tort Immunity Act because the bicyclist was not an “intended” user of the area.
