IFMK Law Shareholder Bhairav Radia and Senior Associate Kyle Moore obtained summary judgment in favor of a county state’s attorney. The plaintiff alleged that the conditions at the jail were horrendous, and there was poor ventilation and black mold throughout. The plaintiff further alleged that the jail provided inadequate medical, dental, and mental health care to the inmates. The plaintiff asserted that he made the state’s attorney aware of the unconstitutional conditions at the jail, but the state’s attorney did nothing in response. The U.S. District Court for the Central District of Illinois found that the state’s attorney had no authority over the jail, lacked personal involvement in the alleged constitutional deprivations, and was immune from the lawsuit.
